On Monday (November 13), the National Pharmaceutical Pricing Authority (NPPA) exercised its powers conferred by the Drugs (Prices Control) Order, 2013, and issued a press release outlining the decision. According to the authority, this move aims to ensure the accessibility and affordability of crucial medications for the masses.
"In exercise of the powers conferred by paragraphs 5, 11, and 15 of the Drugs (Prices Control) Order, 2013, read with S.O. 1394(E) dated the 30th May 2013, and S. O. 5249(E) dated 11th November 2022, issued by the Government of India in the Ministry of Chemicals and Fertilizers, the National Pharmaceutical Pricing Authority (hereinafter referred to as NPPA), hereby fixes the price," stated the press release.

The notification further specified that drug manufacturers are permitted to charge Goods and Services Tax (GST) only if they have either made the payment or it is payable to the government on the retail price mentioned. This strategic move not only regulates the pricing but also ensures that the tax component is transparent and adheres to the prescribed guidelines.
To enhance transparency and accessibility, NPPA has mandated that every retailer and dealer must display a price list and a supplementary price list. Notably, the retail price specified is applicable only to the individual manufacturer and marketer who has applied for the same, avoiding confusion among consumers.
The NPPA's decision is anticipated to have a positive impact on the cost of these drugs, potentially making them more affordable for the general public. The pricing regulations are designed to prevent overcharging, with strict consequences for non-compliance. Manufacturers failing to adhere to the set price cap will be obligated to return the overcharged amount along with interest.
This regulatory intervention aligns with the government's commitment to ensuring access to essential medicines for all sections of society. The move is expected to be welcomed by consumers, healthcare professionals, and advocacy groups alike, as it addresses concerns about the rising cost of healthcare and promotes greater affordability of vital medications.
