Buying a property is never an easy proposition, because of the need to examine carefully the various documents that are involved in buying. Here are a few documents you much check before buying a property in India.
Mother Deed
A property would have changed hands several times over the years and decades. The Mother Deed would have all the details tracing the ownership of the land, apartment to the very first person. This documents must be examined thoroughly before buying a property.
Sanction plans approval
In case you are buying an apartment make sure there is an approval from the relevant authorities. For example in Bangalore, the BBMP provides approval of the plans, without which the project cannot begin.
No objection certificate if there are several owners
In case you are buying a property from resale, then you need to see the NOC, if there are several owners of the property.
Encumberance certificate
This is another important document that you can get from the registar's office. This would show you if the property is in the name of the existing owner and if the property is free from any liabilities.
Title deed
Check the title deed to see if the property is in the name of the existing owner from whom you are buying the property.
It's important that you check the original deed.
Property tax receipts
Check the property tax receipts, especially where the property is an independent house. In case of a city like Bangalore, the BBMP would not transfer the Katha where there are dues with regards to property tax.
No objection from the society
In case of a society one needs to obtain a No Objection Certificate from the society.
Hire a good lawyer
Sometimes, it would be a good idea to hire a lawyer, who will take a look at the original title deed as well as the mother deed.
