Tata Consultancy Services Ltd., one the of the largest outsourcers of American jobs, is facing trial in the US court for discriminating against its US-born employees.

The case against TCS was filed in 2015 by American employees who claimed that the company overly favors imported workers of Indian descent. Employees who were laid off by Southern California Edison after it signed a contract with TCS to outsource its IT jobs for cheaper labor have said that that Indian nationals were imported to replace them. There are claims that they were also made to stay to train the new hires after the layoff.
The District Court in California has denied class certification on the litigation against TCS alleging a pattern and practice of discrimination in hiring against people of non-South Asian origin. It has, however, granted class certification in respect to allegations of discrimination in practices related to the termination of employees. This part of the litigation will move to the next phase of the trial reported PTI.
"TCS will vigorously defend its position and expects a positive outcome," a TCS spokesperson said according to PTI. It has argued to have given fair opportunities to employees of all countries during the Edison transition phase.
The workers that sued Infosys over similar allegations were represented by the same law firm as the one that filed the case against TCS.
