The Union communications minister, Ashwini Vaishnaw, on Monday presented the Telecommunications Bill, 2023 in the Lok Sabha in a bid to replace the outdated 138-year-old Indian Telegraph Act that currently governs the telecom sector.
The bill that got clearance from the Cabinet in August, intends to create a legal and regulatory framework that gives priority to the safety and security of telecommunication networks while promoting inclusive digital growth.

The Bill has also kept the definition of telecommunication services open-ended. Under the final version, "telecommunication service" indicates any service for telecommunication.
In the 2022 version, when the bill was released for the first time it proposed to include services such as WhatsApp, Signal, and Telegram in the definition of telecommunication services.
The Telecommunications Bill, 2023 also deals with the assignment of spectrum and the Bill enables the technologically neutral use of spectrum and optimal utilization of spectrum.
When it comes to changes in the allocation of spectrum for satellite broadband services, the Bill has cleared that spectrum for such services can be assigned on administered prices, without auction. The bill has also curbed the powers of the Telecom Regulatory Authority of India (TRAI) to address concerns raised by industry players.
A look at the key proposals of Telecommunications Bill, 2023:
- The bill includes the proposal to bring internet-based calling and messaging apps, popularly known as over-the-top (OTT) apps, under one umbrella of telecommunications to increase users' safety and ensure that these apps comply with the regulations.
- The proposed law grants the central government the power to take control, manage, or suspend any telecommunication services, networks, or their components in the event of a public emergency. This provision will help the government to effectively deal with emergencies and maintain law and order in the country.
- The bill proposes to empower the government to waive entry fees, license fees, penalties, etc., to ensure fair competition in the market. This provision will promote the affordability and accessibility of telecom services.
- Telecommunications Bill, 2023 also addresses the concerns of industry players regarding the power of the Telecom Regulatory Authority of India (TRAI). It aims to limit the authority's powers and bring more balanced regulations in the sector.
- The bill proposes to ease the refund of fees for licenses and registrations to streamline the rules for companies surrendering their permits.
- There are provisions in the bill for the development and maintenance of telecom networks via right-of-way provisions and the creation of common ducts, which will support the efficient deployment and management of infrastructure.
