The Jammu and Kashmir Cabinet has resubmitted its Transaction of Business Rules (TBR) to Lieutenant Governor Manoj Sinha. This action followed a query from Sinha regarding whether the document was framed according to established rules. Officials confirmed that the Cabinet, led by Chief Minister Omar Abdullah, returned the proposal unchanged for Sinha's final approval.

The Cabinet's decision came after deliberating on the lieutenant governor's concerns about procedural adherence in framing the TBR. The Cabinet concluded that the objections were unfounded and informed the lieutenant governor's office that all necessary procedures had been followed. This move highlights a potential disagreement between the elected government and the lieutenant governor's office regarding administrative procedures.
Procedural Framework and Governance
The TBR outlines how the elected government and the lieutenant governor's office should conduct their affairs. This framework is crucial for ensuring smooth governance in Jammu and Kashmir. The recent Cabinet meeting was significant as it was the first after government offices resumed operations in Srinagar, the summer capital.
One contentious issue involves the transfer of All India Services officers by the lieutenant governor-led administration. These officers have been placed in positions meant for Jammu and Kashmir administrative cadre. According to the Jammu and Kashmir Reorganisation Act, while the lieutenant governor oversees All India Services officers, the Union Territory government manages administrative services officers of the former state.
This situation underscores a potential difference in opinion between the elected government and the lieutenant governor's office on how administrative processes should be managed. The Cabinet's decision to resubmit the TBR without changes reflects its stance on maintaining its procedural framework.
The ongoing discussions between these two entities are crucial for determining how governance will proceed in Jammu and Kashmir. The resolution of these issues will likely impact how administrative duties are divided between local and central authorities in this Union Territory.
